t+ Medical Americas, Inc. (“t+ Medical”) is committed to protecting the privacy and security of personal information that we collect. This Privacy Statement discloses our information gathering and dissemination practices both for our publicly available website at www.tplusmedical.com (the “Public Site”) and for our t+ Medical service, which helps you manage and communicate certain of your healthcare information to healthcare professionals consented by you, and which (in part) is accessed through the internet in accordance with procedures provided by t+ Medical to you (the “Service”). The Service is available only to registered users of t+ Medical who have accepted the Terms of Use (“Terms of Use”) with t+ Medical to provide online access to certain personal healthcare information hosted by t+ Medical, and access to related t+ Medical services. Nothing in this Privacy Statement should be interpreted to modify, delete or add terms to the Terms of Use.

HIPAA and Your Private Information

The Service has been designed to meet federal HIPAA standards for safeguarding the security of personal health information. If and when t+ Medical receives information regarding you from your healthcare providers, we are obligated to treat this information in accordance with HIPAA requirements applicable to business associates. 

Service

Through use of the Service, You will provide certain personal healthcare information for hosting and processing by t+ Medical. Further information about the data collected and the services provided by t+ Medical may be found in the documentation for the Service as well as in the Terms of Use.

You acknowledge and agree that t+ Medical may use personally identifiable information input by you to provide the Service. We may also use your email address or phone (if provided by you) to contact you regarding Service changes; system maintenance and outage issues; account issues; or to otherwise troubleshoot problems.

You acknowledge and agree that t+ Medical, in order to perform the Service, will provide hosting services, software and other tools that enable your healthcare providers, pharmacists, and emergency contacts to access your personally identifiable information. You also agree that your healthcare providers and pharmacists may input data relating to your medical condition and your medication into the Service and associated databases. t+ Medical will use reasonable efforts to ensure that such third parties will keep the data confidential and only process the data for the purposes of providing the Service.  You agree that your healthcare professionals may include such data into your medical records.

t+ Medical uses reasonable security measures to protect against the loss, misuse, and alteration of the information under our control. We store the information in a database in a secure environment at a third-party hosting service provider. t+ Medical takes technical, contractual, administrative and physical steps to protect against unauthorized access to and disclosure of personally identifiable information. All confidential or proprietary information belonging to t+ Medical or its users is handled in confidence and may not be disclosed to unauthorized third parties.

You agree that we may use your data, including personally identifiable information, in statistical analyses and for research purposes, so long as no identifying individual information is included in any such research or statistical analyses.

The Service uses secure socket layer (SSL) to encrypt such when communicating personal information over the internet.  While on a secure page you will see a key or lock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer. On web pages that do not use SSL, the key icon will appear broken (Netscape Navigator) or the lock icon will appear open (Microsoft Internet Explorer).

You acknowledge and agree that, despite these steps, t+ Medical cannot verify or guarantee that its privacy and security practices will be foolproof. 

Finally, the Service has been designed to allow Users to access and update previously provided information.

Public Site

Information Collected

Visitors to the Public Site are not required to reveal any personally identifiable information to t+ Medical. Visitors to the Public Site who wish to receive information regarding t+ Medical products or services may provide us with certain contact information including telephone number, fax number, email address, and mailing address.  t+ Medical collects and uses such information solely for purposes of contacting visitors and delivering requested materials to visitors.

Cookies Information: When you visit the Public Site, we may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that uniquely identifies your browser. t+ Medical uses session cookies that are temporary and disappear after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Public Site may not function properly if the ability to accept cookies is disabled.

Log File Information: When you use the Public Site, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.

We use cookies and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Public Site; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions and contests.

t+ Medical is not responsible for the privacy practices or the content of any other web sites to which we link. We encourage you to review the privacy statements and policies of any such third-party web sites.

Disclosure to Third Parties

Except as set forth herein, t+ Medical will not disclose any personally identifiable information provided by a visitor to the Public Site to a third party unless the visitor has consented to such disclosure.

General Terms

E-mails

Please do not deliver any personal information, including medical information, in e-mails to t+ Medical. t+ Medical shall not be under any obligation to protect the content of e-mails that you send to t+ Medical, including any ideas, inventions, work product, or other intellectual property associated with such e-mails. This privacy statement shall not apply to any such items. 

Children

The Service and Site are not intended for use by children under the age of 18 without parental supervision. A parent or legal guardian may, however, use the t+ Medical service for a minor under his or her legal responsibility. The parent or guardian is solely responsible for providing supervision of the minor’s use of t+ Medical services, and assumes full responsibility for ensuring that the information supplied is accurate and kept secure.   

Contractors and Affiliates

We may provide personally identifiable information to our subsidiaries, affiliated companies, and contractors for the purpose of providing and maintaining the Service and for responding to your requests. We require that these parties agree to use such information solely for this purpose, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.

We may release personally identifiable information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state, federal and international laws or respond to a court order, subpoena, or search warrant.

t+ Medical also reserves the right to disclose personally identifiable information and/or other information about users that t+ Medical believes, in good faith, is appropriate or necessary to enforce our agreements, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our web site and Service, and to protect the rights, property, or personal safety of t+ Medical, our users or others.

t+ Medical intends to protect your privacy to the fullest extent possible as described in this Statement while also fulfilling our responsibility to uphold all applicable laws and regulations. Due to potential legal requirements and other possible circumstances, we cannot ensure that all of your private communications and other personally identifiable information will never be disclosed or accessed in ways not otherwise described in this policy. t+ Medical is committed to cooperating with applicable law enforcement authorities for any individual who believes his, her or its personally identifiable information has been used in violation of applicable laws or regulations. In addition, you agree that we may transfer your information to the purchaser of the portion of our business to which the information relates, or to an affiliated company, but only so long as such party adopts a privacy statement or policy that is substantially similar to this statement.

Updates to Privacy Statement

t+ Medical may from time to time update this Privacy Statement by changing the Privacy Statement on the t+ Medical website. For revisions of this Privacy Statement that may be materially less restrictive on our use or disclosure of your personal information, we will attempt to provide you notice (based on your e-mail contact information you have provided us) before implementing such revisions with respect to such information.
